No IN-FORCE Article 4 removing the C3->C4 small-HMO PD right. The borough is only at the very start of the process: at Full Council on 12 May 2026 (agenda item 26/001, democracy.tmbc.gov.uk/mgAi.aspx?ID=50655) members RESOLVED to compile evidence and submit documentation to support a boroughwide Article 4 removing PD rights for change of use from C3 dwellinghouse to C4 small HMO. A supporting scoping report (democracy.tmbc.gov.uk/ieIssueDetails.aspx?IId=38243) examines whether the evidence base supports such a direction. As of the check date the direction has NOT been made/confirmed and is NOT in force (non-immediate Article 4 directions also require a notice period, typically 12 months, before taking effect). Kent Online coverage confirms this is a newly-initiated, contested proposal, not an existing designation. planning.data.gov.uk holds zero article-4-direction / article-4-direction-area records for T&M organisation entity 345. When eventually confirmed and in force, the proposed area is the whole borough (subject to a floated amendment to focus on wards with live HMO issues), but nothing is in force now.

What happens if you let without a licence

Letting or managing an unlicensed property that needs a licence is a criminal offence, under section 72 of the Housing Act 2004 for an HMO and section 95 for a property caught by selective licensing. A council can prosecute, or impose a civil penalty instead. For conduct on or after 1 May 2026 that penalty can be up to £40,000 per offence, raised from £30,000 by the Financial Penalties (Housing Offences and Breach of Banning Orders) Regulations 2026. Tenants and the council can also apply for a rent repayment order, which for conduct from the same date can claw back up to two years of rent, up from one, under section 103 of the Renters' Rights Act 2025.

Both of those maxima apply only to conduct on or after 1 May 2026. Earlier conduct is still judged against the old £30,000 and twelve-month limits. Each breach is normally penalised separately, so an unlicensed portfolio in Tonbridge and Malling multiplies the exposure rather than capping it.
