An HMO for seven or more residents falls outside class C4 and needs permission anyway.

Evidence: (1) planning.data.gov.uk has ZERO article-4-direction and article-4-direction-area entities for the council (org code local-authority:STR / STR, entity 321). (2) PlanningGeek's comprehensive national HMO Article 4 list (planninggeek.co.uk/gpdo/article-4/hmos) does NOT list Stratford-on-Avon; the only Warwickshire authority with an HMO Article 4 is Warwick District (Leamington Spa, effective 01/04/2012). (3) The council's own HMO advice page (stratford.gov.uk/homes-properties/houses-in-multiple-occupation-hmo.cfm) makes NO mention of Article 4, C4, or planning permission being required to create a small HMO, i.e. C3->C4 remains permitted development district-wide. (4) The only Article 4 document found on the council website (search result 'Direction Made under Article 4(1)', /doc/205759/) is a site-specific TEMPORARY direction (ref 16/00789/PTHENF, made 14 Dec 2016) removing Class B Part 11 DEMOLITION rights on one plot of land edged red, NOT an HMO direction. No HMO/C4 Article 4 exists.

What happens if you let without a licence

Letting or managing an unlicensed property that needs a licence is a criminal offence, under section 72 of the Housing Act 2004 for an HMO and section 95 for a property caught by selective licensing. A council can prosecute, or impose a civil penalty instead. For conduct on or after 1 May 2026 that penalty can be up to £40,000 per offence, raised from £30,000 by the Financial Penalties (Housing Offences and Breach of Banning Orders) Regulations 2026. Tenants and the council can also apply for a rent repayment order, which for conduct from the same date can claw back up to two years of rent, up from one, under section 103 of the Renters' Rights Act 2025.

Both of those maxima apply only to conduct on or after 1 May 2026. Earlier conduct is still judged against the old £30,000 and twelve-month limits. Each breach is normally penalised separately, so an unlicensed portfolio in Stratford-on-Avon multiplies the exposure rather than capping it.
